What's truly amazing about this case to me is that the alleged rapist isn't even on the sex offender lists. I've seen cases where two CONSENSUAL under-age teens had sex and both (or usually the male) get off with no jail time but a lifetime of having to register with the pedo patrol.
I'm not saying that's even close to a solution, but it's incredible that not even THAT managed to happen.

I wonder, if both the victim and the rapist had been male, would people feel the victim "should have known" what was going to happen and was somehow less deserving of sympathy?
And no, I'm not saying homosexuals are predators nor that every young man should be afraid of being raped by another young man.
What I'm asking is if you had an equally murky situation, i.e. both parties are highly intoxicated and impaired, would the same people, who seem so lacking in sympathy for the victim in this case, throw up their hands and say "Oh well, what did he expect to happen? He went to a party at 1:00 AM. He got drunk. He should have been more careful. He probably consented and is only crying 'rape' because he got caught."
