AB1014, an assembly bill in the California Senate is quickly moving on through, and not in a good way.

The new AB, named the "Gun Violence Restraining Orders", effectively allows a search warrant to be issued on the suspicion of "gun violence" causes by word of a 3rd party - no actual evidence or crime needs to be committed, only the suspicion of such a crime.

To say that is concerning is putting it mildly.

While some causes I think are alright - the issue of this GVRO when there is evidence of the sexual exploitation of a child for example - there are a few definitions that are highly concerning:

"(8) When the property or things to be seized include an item or any evidence that tends to show a violation of Section 3700.5 of the Labor Code, or tends to show that a particular person has violated Section 3700.5 of the Labor Code."

What is 3700.5 of the CA Code? It deal with employers having secured payments for compensation towards employees. There are many types of employers that need no security for payment or because of their operations, cannot secure payments (cash businesses for example or sole-proprietors).

So... if I'm a small business owner and I pay my employees on time every time, and don't buy secured payments from banks for compensation, then I lose my guns. How the heck is that related to violence or guns?

Much more troubling is this section, which is early on in the bill:

"(3) When the property or things are in the possession of any person with the intent to use them as a means of committing a public offense, or in the possession of another to whom he or she may have delivered them for the purpose of concealing them or preventing them from being discovered."

Note that it says intent. This opens the door for a neighbor, seeing you unpack your revolver for cleaning in your backyard, to report you for intent to commit a public offense (anything from brandishing to murder to jaywalking since the offense isn't codified) and you lose your guns. If you send your guns away out of state, CA can apparently go and fetch your guns from relatives or a gunsmith.

All that on the word of a random 3rd party. I tend to have little faith in the average man on the street concerning firearms in CA purely because of the incredible amounts of propaganda in the state against firearms - it creates a culture of fear when no crime or harm has actually happened, no injury to the public.

But sure, there aren't any gun grabbers out there. It's all a myth.

you're quoting the current penal code not the proposed amendment, which is:

14) When the property or things to be seized are a firearm or firearms or ammunition that is in the custody or control of, or is owned or possessed by, a person who is the subject of a gun violence restraining order that has been issued pursuant to Division 3.2 (commencing with Section 18100) of Title 2 of Part 6 and who is presently known to have in his or her custody and control or possession, or to own a firearm or firearms or ammunition.
