There is a wall blocking access to the property and the other figure was trying to warn him. This would probably allow for the defense of Assumed Risk. Since the sinking was not the product of a volitional act of the defendant, the elements of the intentional tort of False Imprisonment would not be satisfied. However, depending on jurisdiction, there may be other concerns such as a Duty to Rescue. Barring jurisdictional concerns, I would suspect that, if anything, only nominal damages would be awarded.
