2. No. Even stretching that statement to apply to the 2nd Amendment, still no.
3. Policy is made is appellate courts, and really all levels of the judiciary. The speech she made wasn't supporting this notion, but recognizing its reality. Once again the only hope of turning it into a criticism is either to completely ignore the context and distort the meaning, or just make things up.

Then you should go back to the poetv vid where that white guy debating on the side of Affirmative Action explains how elimination of what we today call Affirmative Action does not lead to equal opportunity among people, but rather an ingrained Affirmative Action for whites. Obama even spoke to this point when he addressed "race" in America, when he mentioned how blacks were forbade from joining unions, disallowed bank loans to buy homes, etc.

I mean, we all would like to think that we'd totally have been anti-Nazi in WWII Germany, pro-civil rights before the Brown decision, etc. But I think it takes more honesty and understanding of the gravity of the time period to admit this. Not everyone can risk losing your livelihood and having you and your family harassed for the rest of your lives by white-power psychopaths.
